Is a mural copyrighted?
Simply because a mural is displayed on a street, it is not free for the taking any more than the cars parked there. Under the federal Copyright Act copyright protection exists for a work from the moment the work is created, and registration with the US Copyright office is optional (though certainly a good idea).
How do you tell if a painting is in the public domain?
Here are some general guidelines.
- Any work published before January 1, 1923, is in the public domain.
- Any work published between 1923 and 1977 that doesn't have a copyright notice, is in the public domain.
- Any work created between 1923 and 1963 with a notice but copyright wasn't renewed, is in the public domain.
